DeadFishAustraliadead fish’s reputation washed up on the shores of Australia last week.

Carol Cross is a friend of mine.

She drives me crazy at times with her repetition. But, then again, I irritate people too. :-)

I allow anyone to post on FranchiseFool. Carol tells me she is still banned from contributing at the FranchiseeFishNet.org.

This is unacceptable to me.

Carol cannot even see The Fish on her computer: that’s right, she’s that blocked. This is wrong on so many levels.

It’s not wrong because she’s my friend: It’s evil because she is  a person. Plus a citizen of the greatest democracy on earth. A veteran’s wife. A former franchisee invest0r.

This is  offensive to anyone that ever believed in the right of free speech, natural justice, military honour, the rule of law, democracy…

If you feel you “have to” block, censor, gag or burn books, you better take another look at your business model.

And, I suggest, the “friends” you have as advisors.

Any industry that can be shown to be fascists by an  little old lady isn’t deserving of any investment, let alone respect.

PS: I was stopped for a day (Nov 12, 2009) as a registered contributor to The Fish last week. I’ve put up with 1,001 cheap shot comments for a full 3 years (459 points) now. I have no fishy, behind-the-scenes telephone calls: I never explain or complain or apologize. I had to post as a Guest and was reinstated for a day.

My offense?  I wrote and posted a very valid post (I think) about economic fascism (Arguments in the Service of Power (subjective truth)) that was clearly addressed to Ray Borradale in Australia. I intentionally hid the Hitler, Goebbels and Mussolini quotes. I wonder when the post will be deleted? Good thing I captured it beforehand.

If anyone else alive or brain-dead took offence to having their behaviour compared to fascists…well..if the show fits…

Then the fish goes ahead and wears it.

That post and and 16 McLuhan quotes were thrown into the fish’s text ghetto: Ranter’s Soapbox, Way Off Topic Posts.  This is where all politically honest objective truth posts are put.

I was reinstated and my posts exist (for now). Some old lady named Carol is still is banned from the fish. I tested the waters, intentionally, one day after Canada’s Remembrance Day. My parents both fought and my Uncle Neil died resisting historical Nazis in WWII. I was not going to be bullied by a Guest troll.

You decide if totalitarianism is alive or dead in franchising today. Who is crooked, misleading and/or tyrants?

Symbols: Strength through Unity

Michael Webster over at Misleading Advertising Law picked up on my recent posting: Franchising is the latest Big Con.

I absolutely agree with him: the best defense against post franchisor opportunism is a well-funded, professionally managed independent franchisee association, IndFA.

There is no substitute for collective action and only a fool thinks otherwise.

The power of “sticking together” has historically been represented by rods that are bound together, often with an axe in the middle (fasces: from the Latin meaning “bundle”). The English word fascist is also derived from this root.

  • In ancient Rome, the bodyguards of magistrates carried fasces and it came to symbolize authority. On early American coins, the fasces symbolizes the unity of the colonies, strength in numbers (A single stick may be broken, but a number of sticks bound together are invincible).

Fasces show up on seals (state of Colorado, two of them crossed on the seal of the U.S. Senate, the Knights of Columbus, {above), the Administrative Office of the United States Courts, and the fascist party under Benito Mussolini.


il Duce Franchise Lawyer

Il Duce means leader in Italian.

It is a term that is often applied by those that choose to influence others in a dictatorial manner.

A national franchise association assists the setting up and marketing of business format franchises in that country.

They lobby and represent the franchisors’ view and oppose franchisees when their interests are in conflict with their masters’.

Most national associations are members of the World Franchise Council, WFC. The WFC is headquartered in the franchise powerhouse nation of Belgium and controlled by the U.S. International Franchise Association.

Each Nation: Every country has one lawyer who is recognized as Il Duce, the general, the top dog or alpha male (ie. the individual in the community to whom the others follow and defer.).

He wields influence primarily through the national franchise association where he is often the general counsel, Chairman of the Board or other such title.

Their job is to co-ordinate the defence and promotion of franchising within their country.  They are profit maximizing businesspeople who rely on the public’s erroneous belief in their professionalism and impartiality. They give advice freely when they there is no client:solicitor duty to do so (before a contract is formed) and remain in the shadows otherwise.

Because of the credence good nature of legal services and their closely guarded monopoly on providing legal services, many franchise lawyers act as fraudulent experts. They are fully aware of this which explains why there are so many unhappy lawyers.

The Il Duce is seen as an expert who is never personally tested on his abilities by a discerning superior: He never goes to Court. These cowards:

  1. control their clients (franchisors) by preying on their fears of what franchisees could accomplish if franchisees were smart and organized (the weakest franchisee group is stronger than the strongest franchisor),
  2. promotes the self-serving and hazardous thought that you should talk to only to a franchise lawyer (akin to having a murderer’s brother performng the autopsy),
  3. make sure the most lucrative legal service referrals (international expansion from North American franchisors) go only to lawyers who “play by the rules” (franchise lawyers who “support” the franchisors’ position),
  4. speak to governments under the guise of an “impartial” expert (although they NEVER take on franchisee cases),
  5. punishes franchisee advocates by suing them into bankruptcy (just for fun and as an example),
  6. award revenue-generating opportunities (speaking at association-sponsored trade shows) to themselves and “their team”,
  7. write carefully crafted legal columns in the national franchisor-sponsored trade rag (sales: see FranchiseCanada magazine or pseudo-journalism, see Franchise Times),
  8. a senior partner of an internationally influential multi-line law firm (allies of friends into political back rooms),
  9. degrades the political process credibility by showing that money buys laws,
  10. keep active in the state, national and international bar associaitons, and, especially
  11. the American Bar Association’s Forum on Franchising (the latest and greatest ways to serve those that buy 95% of their services: ie. franchisors),
