    Here in the United States, I would call it not only “inappropriate regulatory structure” but DISHONEST regulatory structure, especially the FTC Rule that governs the sale of franchises to the naive public.

    When you read the books about the meltdown, you can see that “stealing by deceit” is legalized and that our elected officials are educated to make and to change the laws that enabled this great feast of lust and greed these past 30 years or more.

    Doesn’t look hopeful! So little attention paid to the recently released reports of the experts who investigated the cause(s) of the meltdown. Looks like more of the same will produce more of the same!

    Regulatory Capture is bipartisan in its support of all major political parties around the world. It is the power to turn a corner or not turn a corner. Peasant curriculums cover ‘this is how it works’, not ‘this is how it should work but it doesn’t’. If the GFC wasn’t a wakeup call I’m not sure what it would take.

    Sure! The average citizen thinks franchising is “great” and has no understanding of the exploitive nature of the business model. The IFA says that the average Congress person doesn’t know the difference between a franchisor and a franchisee. They too! — our elected representatives, just like prospective and innocent buyers of franchises, think that franchisors can’t succeed if the franchisees don’t succeed. They don’t understand or want to look at “managed churning” and the underlying truth of how risky franchising is for franchisees whose assets (small businesses) can only be used in the service of the brand franchisor.

    This business model, called franchising, becomes deadly for franchisees when the risk in terms of UNIT performance doesn’t have to be disclosed to new buyers. Prospective franchisees innocently and unknowingly invest in pigs and dogs that are eligible for government loans. Compounded churning becomes invisible and the growing visibility of franchises suggests that franchises are good investments.

    It just really ticks me off that my government in the Land of the Free and the Brave lied about the SUBSIDY that they have given to the franchisors and the other special interests who profit from dishonest and inappropriate disclosure of the risk of buying a franchise.

    Just easier and more profitable for the three branches of government to do nothing about FLAWED regulation and let the victims, whose voices can be silenced, fade away into obscurity!
